Consumer Warranties – mandatory text for services

If you provide services to consumers and provide some form of warranty against defects you must adhere to some updated mandatory requirements of the Australian Consumer Law (ACL).

In addition to the specific information already required, a document evidencing a warranty against defects must also include mandatory text to ensure consumers are aware that any warranty against defects operates in addition to consumers’ rights under the ACL, particularly the consumer guarantees.

Although already a requirement for goods, from 9 June 2019, the mandatory text is required for all services and combined goods and services.

To update your business terms and conditions and warranty documents or discuss internal processes that will best limit your businesses liability while staying the right side of the ACL, talk to us.
