Harwood Andrews provide a range of services in the banking and finance sector.
We act for a number of financial institutions in preparing and registering security documents, including mortgages, fixed and floating charges and general security deeds under the Personal Property Securities Legislation. We assist lenders in drafting the terms of their security documents. We also assist a range of non-bank financial institutions in preparing documents to assist in their raising of funds either from bank or other financial institutions or from members of the public, including prospectus issuing, Consumer Credit Code and Corporations Act compliance.
We act for lenders in the enforcement of securities, which covers a range of activities, from simple debt collection procedures to effecting a right of sale over land or other property in the subject of the security or the appointment of external administrators to take control of the assets.
For our business clients, we act in negotiating and settling the terms of their banking and financing facilities, incorporating such activities as considering and negotiating the terms of letters of offers received from banks, and reviewing security documents.
