New powers of attorney

From 1 September 2015, new powers of attorneys will come into effect in Victoria.

The Powers of Attorney Act 2014 (The Act) introduces the following powers of attorneys:

  1. Non Enduring Power of Attorney (replaces the old General Power of Attorney);
     
  2. Enduring Power of Attorney (combines the old Enduring Power of Attorney Financial and Appointment of Enduring Guardian); and
     
  3. Supportive Attorney (completely new power of attorney)

The existing Enduring Power of Attorney (Medical) is not affected by the Act and will continue to operate in its current form.

Also any General Power of Attorney, Enduring Power of Attorney Financial and Appointment of Enduring Guardian entered into before 1 September 2015 will remain valid and continue to have effect.
